[NINTENDO HAS CLAIMED THIS VIDEO] is the 36th episode of Season 12 and the seven hundred and thirtieth overall to be uploaded on the Crossover Time & SMG4 channel.

This is the fifth episode of The Lawsuit Arc and led to the second downfall of SMG4's Gang at the hands of Lawyer Kong. It was aired on September 24, 2022.

Synopsis[]

Mario and Luigi are in prison and try to escape.

Plot[]

Inside the Firewalled Mushroom Kingdom, the Mario brothers are imprisoned in a dungeon, awaiting their punishment as they play music in their cell. When interrupted by Lawyer Kong, Shigeru Miyamoto came to ask about the commotion. Lawyer Kong had to reveal the truth about what happened to Mario: SMG4's arrival had induced memes and stupidity in the Mushroom Kingdom, shocking Miyamoto. Lawyer Kong presented a Super DMCA, an upgrade over the original DMCA that will allow an instant takedown of SMG4, Luigi relies the Super DMCA and explains to Mario that if Miyamoto signed it SMG4 and their Non-Nintendo friends will erase from existence forever (but except for Bob and Fishy Boopkins since they were Nintendo characters).

Meanwhile in Francisco Fajardo, SMG4 and Meggy are searching at Wikipedia Castle to find anything related to IPs, resisting hazards along the way, such as Ned Flanders from the anime IP, the Serial Killers pretending to be statues and the weird animals IP, which SMG4 wants to forget about it after witnessing some non advertising-friendly stuff behind that door. Arriving at the law chamber, they needed to find a book pertaining to parody law, allowing them to write a parody contract that would keep SMG4 running. Meanwhile, as Miyamoto was about to sign the Super DMCA, Mario intervened to convince him to put the non-Nintendo characters in games, to which he agreed while warning them that he will sign the Super DMCA if quality worsens. As Mario and Luigi showed Miyamoto their ideas (like a Starbucks Coffee Simulator, where Karen must survive a horde of Karen Bobs that want to speak to the manager), Meggy and SMG4 were still struggling to find the book, until SMG4 did a quick Wikipedia search that called in the book. Using her law skills, Meggy wrote a parody contract on a piece of toilet paper that SMG4 brought, racing back to Mario.

As Mario's game ideas were starting to displease Miyamoto, they were pitching an idea for an SMG4 DLC for Phoenix Wright. Furious that this was taking too long, Lawyer Kong asked if Miyamoto made his decision. Forced to be convinced by Lawyer Kong that nothing can come good from Mario's ideas, he hesitantly and reluctantly decided that he would sign the Super DMCA, jeopardizing SMG4's future. SMG4 and Meggy came running too late, with Meggy attempting to swipe the Super DMCA with the parody contract was averted by Lawyer Kong, who smacked the contract away. With the Super DMCA signed, the non-Nintendo characters ceased to be, with Mario, Bob and Luigi looking with horror as they see the non-Nintendo characters collapse and their spirits temporarily leave their bodies in front of them. Lawyer Kong could only be impressed as he succeeded his plan to get rid of SMG4 for his own good, as Mario held a dying Meggy as she says that they didn't make it in time Mario don't want her to say that and he'll fix this last words that she glad that she met him and "hugged" Mario (Unknowningly to Mario, Meggy slipped the parody contract in his hat just before her temporarily apparent death off-screen so that he can bring the SMG4 Gang and the Non-Nintendo characters back to life in the next episode), while SMG4, who is spared by Lawyer Kong, could only look in shock and horror, knowing that his worst fear that the end of his SMG4 channel as he knows it, has come true. The episode ends on a massive cliffhanger without the outro music.

  • As a possible oversight, Old Man Hobo was categorized as a non-Nintendo character despite being based on a Pokémon NPC. However, this could also be due to the fact that his new 3D model is an original one, similar to Meggy changing from an Inkling to an original character.

  • The greyscaled outro with silence from the The Anime Arc, The YouTube Arc, Genesis Arc, and Revelations Arc is reused.
  • This marks the first appearances of:
    • Ugandan Knuckles since SMG4: If Mario Was In... Sonic Movie 2.
    • Markiplier since Mario Googles Himself.
    • Kaizo Koorumaniru since Mario Reacts To Nintendo Memes 10.
    • Mark Zuckerberg canonically since SMG4: The Floor is Lava.
    • Melony since SMG4: If Mario Was The Last Man On Earth.
  • This is the very first episode where Mario bathed in spaghetti in his underpants, instead of lying naked on a plate.
  • This is the only episode where there is no N64 model usage.
  • Irony: SMG3 is defeated as it was SMG4's former rival before to make in past context.
  • Despite also being an original character, Fuego the Water Bottle didn't appear in this episode likely due to possibly being killed off already by accident during his last previous appearance in SMG4: If Mario Was In... Anime.
  • After this episode was released, the channel banner changed again to reflect Lawyer Kong's Super DMCA. SMG4 and the other non-Nintendo characters are more transparent than before while Mario looks confused, Luigi looks worried, and Bob and Boopkins look shocked. And Bob's shades slowly down with their wares on the hand no longer exist.
    • While SMG4 is also fading away on the channel banner, he didn't yet end up fainting in the video.
    • Mario's mustache is also smaller than before.
    • Wizard Rock was also fixed from the last episode as he was not transparent.
  • This episode bears some similarities to SMG4: Deleted, as both episodes had characters temporarily dying, but in this episode, every single non-Nintendo character died. Additionally, in SMG4: Deleted, Luigi, Fishy Boopkins, and Bob all died (although they are sent to the Internet Graveyard), but in this episode, they survived.
  • This episode is so far one of the darkest episodes in SMG4 history, killing all of the non-Nintendo characters besides SMG4 at once, albeit yet to be revived.
    • This means it is currently unknown if there will be any permanent deaths like the prior 4 arcs, or if all characters are going to be revived safely. However, in SMG4: Goodbye SMG4, it was shown that they've all been revived, thanks to Kirby signing the Parody Contract Mario gave him (which Meggy hid in his hat).
    • Ramensay & Mushroom Robber didn't appear to be revived in episode after that one.
      • Ramensay & Mushroom Robber are the shortest lasting characters, if that is counted.
      • Mushroom Robber only has been revealed to be revived in SMG4: How to Train your Mario.
  • It is unknown why Meggy was able to survive longer than the rest of the cast before dying, enough to share a goodbye with Mario. The most likely explanation is that her origins as an Inkling gave her some mild protection from the effects, but it wasn't enough to save her.
    • Similarly it is unknown why SMG4 is the sole survivor in the episode despite not being Nintendo-based.
      • It's possible that this is because he was the first original character before the others were introduced, although this does not explain why SMG1, 2 and 3 were impacted as well.
      • It is also possible that Lawyer Kong made him exempt from the effects to be able to watch him suffer.
      • Finally, it's possible that since SMG4 is loosely a representation of Luke himself, despite no longer being an actual personification since the Genesis arc, he is immune since he is the owner of the channel, and hence needs to deal with the consequences of his creations vanishing.
        • It was revealed in SMG4: Goodbye SMG4 that his survival was because he was indeed the channel owner, and was forced to delete said channel afterwards, thus killing him as well, however he was immune to the direct effects of the DMCA himself..
        • In War Of The Fat Italians 2022 (Official Trailer), there is an alternate shot of that episode, showing SMG4 dying when approaching Mario, albeit it could not had happened at all.
  • Despite not originating in the SMG4 universe, SMG1 and SMG2 still were affected by the DMCA even though they came from Old Universe at first, but it’s possible they’re affected by the laws of physics and since their avatar is dead, it allowed the DMCA to effect them, but the real reason is unknown.

  • Kirby presiding as a judge for Nintendo may be a reference to John Kirby, Nintendo's lawyer during the suit against Donkey Kong by King Kong's studio, Universal Pictures.
  • Spongebob SquarePants: Mario’s face in the thumbnail is a reference to SpongeBob’s picture in the episode "Christmas Who?"
